A New Canaan woman was arrested by warrant on Aug. 21 and charged with assault of public safety personnel, a felony, after she allegedly spit on a police officer during processing for a domestic incident on June 6, according to court records and a police affidavit.
Officers transported Brooke Noell, 40, of South Avenue to New Canaan Police Department headquarters at about 5:38 p.m. on June 6 after she was identified as the aggressor in a domestic dispute, according to a police affidavit that forms the basis of an arrest warrant application signed Aug. 7 by a state Superior Court judge.
At headquarters, Noell was 'uncooperative' and directed several comments at an officer, including 'You're going straight to hell [expletive], you're going to burn there just like your ancestors,' and made references to a 'dead baby,' 'abortions,' 'illegitimate children,' and 'dead [expletive] husbands,' the affidavit states.
Authorities determined Noell should be taken to a hospital, and New Canaan Emergency Medical Services was dispatched at about 7:21 p.m. While still in her holding cell, she 'continuously repeated that she was not going to the hospital, demanded to be released as she paid her bond, asked us to open the door and let her out, and kicked the cell door,' the affidavit said.
As officers removed her from the cell, Noell 'resisted and tried to pull away,' the affidavit states. After NCPD Lt. Aaron LaTourette and the targeted officer 'got control of Noell's arms to handcuff her, at approximately 1951 hours, Noell spit in my face, I felt it on my cheek and near my lip,' the officer wrote. Noell then attempted to spit again, at which point LaTourette stabilized her head, according to the affidavit.
While in the ambulance at approximately 8:03 p.m., Noell stated, 'I have Hepatitis C, HIV, Herpes, [the officer] now has all those diseases too,' the affidavit said.
Noell turned herself in on the active warrant at about 9:30 a.m. on Aug. 21. Connecticut Judicial Branch records show she was also arrested in May and charged with disorderly conduct and third-degree assault, and arrested twice in June on charges including disorderly conduct, third-degree assault, violation of a protective order, and first-degree criminal trespass. She is out on bond and scheduled to appear in court on Sept. 15. She is represented by Stamford attorney Robert Anthony Famiglietti, according to court records.
